Terms of participation for online contests
1) Scope
These terms of participation apply to all contests conducted by Qeridoo GmbH, Industriepark Nord 100, 53567 Buchholz (hereinafter "Organizer"). Each participant agrees to these terms of participation by participating.
2) Participation
2.1 Eligible to participate is any natural person in their own name with a minimum age of 18 years. Participants who have already completed their sixteenth year of life but are not yet of legal age may only participate in the contest with the consent of their legal guardians.
2.2 Excluded from participation are minors younger than 16 years and persons without legal capacity.
2.3 The Organizer reserves the right to exclude persons from participation who violate these terms of participation or gain or seek to gain an advantage over other participants through unlawful influence or manipulation of the contest. In these cases the Organizer can also subsequently exclude participants from the contest, revoke prizes and reclaim them.
2.4 Participation is only possible within the period specified in the contest description. Each participant may only participate once in an identical contest.
2.5 Excluded from participation in the contest are employees of the contest Organizer and their direct relatives.
3) Execution of the contest
3.1 Prerequisite for participation in the contest is fulfilling the conditions specified in the contest description. The contest is conducted in the specified period. All participants in the contest are considered who fulfill the prerequisites specified in points 2 and 3 by the respective time of the drawing. Immediately after expiry of the participation period, the winner is drawn randomly from among the participants.
3.2 A change or cash payment of the prize is excluded. The prize is not transferable.
4) Prize processing
4.1 The winner is notified by email or DM on Instagram by the Organizer. Regarding the prize, every participant so notified is obligated to inform the Organizer within one month after dispatch of the notification whether they accept the prize. If the Organizer does not receive a corresponding message within this period, the option to accept the prize lapses and the Organizer reserves the right to determine another participant and notify them accordingly.
4.2 If the contact options provided by the participant are incorrect (e.g. email address), the Organizer is not obligated to determine the correct data. The disadvantages resulting from providing incorrect contact data are borne by the participant.
4.3 In the case of a drawing of a voucher, the claim to it lapses even when the transmission of the voucher cannot occur within 6 months after the first notification of the Organizer about the prize for reasons that lie in the person of the winner.
5) Liability for defects
For damages incurred to the winner due to material and/or legal defects, the Organizer is liable only in cases of malice, intent or gross negligence. Otherwise, liability for material and/or legal defects is excluded.
6) Early termination, adjustment or modification of the contest
The Organizer is entitled to terminate, adjust or modify the contest at any time without prior notice and without giving reasons early if proper execution of the contest cannot be ensured without corresponding measures for technical or legal reasons.
7) Applicable law
For all legal relationships of the parties, the law of the Federal Republic of Germany applies. For consumers, this choice of law applies only insofar as the protection granted by mandatory provisions of the law of the state in which the consumer has their habitual residence is not withdrawn.

8.1. Processing of your personal data within the framework of the contest
We process your personal data for the proper execution and processing of the contest and in particular for sending the prize.
To execute the contest, the first and last name and the email address of the respective participant are collected and stored. To send the prize, we additionally collect the address from the winner(s) and pass this data on to a shipping company commissioned by us. A passing on of your data to third parties beyond this does not occur.
The legal basis for these processings of your personal data is Art. 6 Para. 1 lit. b GDPR (execution of pre-contractual measures and fulfillment of a contract).
Insofar as we publish the first and last name of the winner(s) separately on our profile or our fan page, or announce them externally, for example in our online shop, this occurs only with the prior explicit consent of the winner(s) according to Art. 6 Para. 1 lit. a GDPR.
If participation in the contest is made dependent on consent to receive our newsletter, we additionally collect your email address for the purpose of newsletter dispatch. For sending the newsletter we use the so-called double opt-in procedure. This means that we will only transmit email newsletters to you when you have explicitly confirmed to us that you consent according to Art. 6 Para. 1 lit. a GDPR to the collection and storage of your data for sending the newsletter.
We will then send you a confirmation email asking you to confirm by clicking a corresponding link that you want to receive newsletters in the future. By activating the confirmation link you give us your consent for the use of your personal data according to Art. 6 Para. 1 lit. a GDPR. The data we collect when signing up for the newsletter is used exclusively for purposes of promotional contact via the newsletter. Passing on to third parties does not occur.
You can unsubscribe from the newsletter at any time via the link provided in the newsletter or by sending a corresponding message to the controller named at the beginning. After unsubscribing, the newsletter dispatch is stopped and your email address and any further data provided in this context are immediately deleted from our newsletter distribution list, unless you have expressly consented to further use of your data or we reserve a use beyond this which is legally permitted and about which we inform you below.
8.2. Storage duration
After the end of the contest, your personal data processed within the framework of the contest will be deleted at the latest three months after the end of the contest, unless there is a valid consent to further processing (e.g. regarding newsletter dispatch) and/or there is a legitimate interest on our part in continued storage.
8.3. Your data subject rights
Applicable data protection law grants you the data subject rights listed below:
- Right of access according to Art. 15 GDPR:
You particularly have a right to information about your personal data processed by us, the processing purposes, the categories of processed personal data, the recipients or categories of recipients to whom your data has been or will be disclosed, the planned storage duration or the criteria for determining the storage duration, the existence of a right to rectification, deletion, restriction of processing, objection to processing, complaint to a supervisory authority, the origin of your data if it was not collected from you by us, the existence of automated decision-making including profiling, and, where applicable, meaningful information about the involved logic and the scope and intended effects of such processing for you, as well as your right to information about which guarantees according to Art. 46 GDPR exist when forwarding your data to third countries;
- Right to rectification according to Art. 16 GDPR:
You have a right to immediate rectification of incorrect data concerning you and/or completion of incomplete data stored with us;
- Right to deletion according to Art. 17 GDPR:
You have the right to demand the deletion of your personal data if the prerequisites of Art. 17 Para. 1 GDPR are met. This right does not exist, however, particularly if the processing is necessary for exercising the right to freedom of expression and information, for fulfilling a legal obligation, for reasons of public interest or for asserting, exercising or defending legal claims;
- Right to restriction of processing according to Art. 18 GDPR:
You have the right to demand the restriction of the processing of your personal data, as long as the correctness of your data disputed by you is being checked, if you refuse a deletion of your data due to inadmissible data processing and instead demand the restriction of the processing of your data, if you need your data to assert, exercise or defend legal claims after we no longer need this data after the purpose has been achieved, or if you have lodged an objection for reasons of your particular situation, as long as it has not yet been determined whether our legitimate reasons prevail;
- Right to information according to Art. 19 GDPR:
If you have asserted the right to rectification, deletion or restriction of processing against the controller, the controller is obligated to communicate this rectification or deletion of the data or restriction of processing to all recipients to whom the personal data concerning you was disclosed, unless this proves to be impossible or involves disproportionate effort. You have the right to be informed about these recipients.
- Right to data portability according to Art. 20 GDPR:
You have the right to receive your personal data that you have provided to us in a structured, common and machine-readable format, or to demand transmission to another controller, insofar as this is technically feasible;
- Right to withdraw consents granted according to Art. 7 Para. 3 GDPR:
You have the right to withdraw consent once given to the processing of data at any time with effect for the future. In case of withdrawal we will immediately delete the affected data unless further processing can be based on a legal basis for processing without consent. The withdrawal of consent does not affect the lawfulness of processing carried out based on the consent until the withdrawal;
- Right to complaint according to Art. 77 GDPR:
If you are of the opinion that the processing of the personal data concerning you violates the GDPR, you have, without prejudice to any other administrative or judicial remedy, the right to lodge a complaint with a supervisory authority, particularly in the member state of your residence, your workplace or the place of the suspected violation.
